2. Acceptance of Terms

By accessing this website, creating an account, or placing an order, you confirm that you have read, understood and agree to be bound by these Terms and Conditions, together with our Privacy Policy, Shipping Policy and Cancellation & Refund Policy, which form part of these Terms.

If you do not agree to these Terms, please do not use this website or place an order.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to place an order. By placing an order you warrant that you meet these requirements and that all information you provide is accurate and complete.

4. Products

4.1 Nature of our products

TuneBoss products are aftermarket engine control units (ECUs), tuning modules, dataloggers, harnesses, accessories and associated software for motorcycles. They are performance and motorsport products intended for use by persons with appropriate technical knowledge.

4.2 Intended use and compliance

Our products alter the factory calibration and operating parameters of a motorcycle engine. They are supplied for off-road, closed-circuit, competition and research use. Fitting these products to a vehicle used on public roads may:

  • void the manufacturer's warranty of the vehicle;
  • cause the vehicle to fail roadworthiness, emissions or type-approval requirements; and
  • contravene road transport, emissions or insurance laws in your country.

It is your sole responsibility to determine whether the use of our products is lawful in your jurisdiction and for your intended application. We do not represent that any product complies with the road-vehicle regulations of any particular country.

4.3 Technical risk

Improper installation, incorrect calibration, unsuitable fuel, mechanical defects or modifications outside published specifications can result in engine damage, component failure, loss of vehicle control, personal injury or death. You accept these risks and agree that you are responsible for the installation, tuning and testing of any product supplied by us.

4.4 Product information

We take reasonable care to describe products accurately, but specifications, compatibility lists, photographs and firmware features may change without notice. Colours and finishes may vary slightly from images shown. Vehicle compatibility listings are provided as a guide; you are responsible for confirming compatibility with your specific model, year and market variant before ordering.

5. Software, Firmware and Tuning Credits

5.1 Licence, not sale

Any firmware embedded in our hardware and any software supplied by us (including the TuneBoss PC application, mobile application and related tools) is licensed, not sold. You are granted a non-exclusive, non-transferable, revocable licence to use that software solely with genuine TuneBoss hardware that you own.

5.2 Restrictions

You must not, and must not permit any third party to: reverse engineer, decompile, disassemble, extract, clone, modify or create derivative works from our firmware, software or hardware; circumvent any security, licensing or device-locking mechanism; or redistribute, resell or sub-license our software.

5.3 Device locking

Our hardware is locked to our software ecosystem. Attempts to bypass this locking will void all warranties and may permanently disable the device.

5.4 Tuning credits and digital items

Where tuning credits, software licences, activation codes or other digital items are sold, these are delivered electronically and are consumed on use. Once credits have been issued to your account or a code has been delivered, they are non-refundable and non-transferable, except where the item is defective and we are unable to remedy the defect. Credits have no cash value and may carry an expiry period stated at the time of purchase.

5.5 Updates

We may issue firmware or software updates at our discretion. We do not guarantee that any particular feature will be maintained indefinitely, or that older hardware revisions will remain compatible with future software versions.

6. Orders and Contract Formation

  1. All orders placed through the website are an offer by you to purchase the products, subject to acceptance by us.
  2. An order confirmation email acknowledges receipt of your order but does not constitute acceptance.
  3. A binding contract is formed only when we dispatch the products and send you a shipping confirmation.
  4. We reserve the right to decline or cancel any order, in whole or in part, including where the product is unavailable, where there is an error in pricing or product description, where we suspect fraud or reseller activity contrary to our dealer policy, or where we cannot lawfully supply to your location. If we cancel an order you have already paid for, we will refund you in full.

7. Pricing and Payment

  1. Prices are displayed in the currency shown at checkout and are subject to change without notice.
  2. Unless expressly stated otherwise, prices are exclusive of shipping charges and exclusive of import duties, taxes and customs clearance fees applicable in the destination country.
  3. Malaysian Sales & Service Tax (SST) or other applicable taxes will be applied where required by law and shown at checkout.
  4. Payment is processed by third-party payment gateways. We do not store your full card details. By submitting payment information, you confirm that you are authorised to use the payment method.
  5. If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and refund any amount paid.

8. Dealer and Reseller Purchases

Our online store is intended for end users. Purchases made for the purpose of resale, distribution or export without our written authorisation are prohibited and may be cancelled. Authorised dealers must purchase through their normal dealer channel and terms.

9. Warranty

  1. Hardware products carry a limited warranty of [[WARRANTY_MONTHS]] months against manufacturing defects in materials and workmanship, from the date of warranty activation.
  2. For products purchased through this online store, the warranty period begins when you complete product registration. Products ship with firmware enabled but the warranty clock does not start until registration is completed.
  3. The warranty covers repair or replacement, at our option, of the defective unit.
  4. The warranty does not cover: physical damage, water ingress, impact, crash damage, incorrect wiring, reverse polarity, over-voltage, heat damage from improper mounting, damage caused by the vehicle's charging or ignition system, unauthorised opening or modification of the unit, removal or defacement of serial numbers or seals, attempts to bypass device locking, normal wear, or any consequential damage to the vehicle, engine or other components.
  5. The warranty is non-transferable and applies only to the original purchaser.
  6. Warranty claims must be initiated by contacting [[SUPPORT_EMAIL]] with your order number, serial number and a description of the fault.

10. Limitation of Liability

To the maximum extent permitted by law:

  1. Our total aggregate liability arising out of or in connection with any product or order shall not exceed the amount you paid for that product.
  2. We shall not be liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of use, engine or vehicle damage, towing or recovery costs, race entry costs, loss of data, or downtime.
  3. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including rights you may have under the Consumer Protection Act 1999 (Malaysia) or other mandatory consumer protection legislation applicable to you.

11. Intellectual Property

All content on this website — including the TuneBoss name and logo, product designs, firmware, software, text, graphics, photographs and documentation — is owned by or licensed to FSR Technology Sdn Bhd and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any of it for commercial purposes without our prior written consent.

12. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [[SUPPORT_EMAIL]] if you suspect unauthorised use. We may suspend or terminate an account that is used in breach of these Terms.

13. Prohibited Conduct

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.
